The Division requests that the Applicant provide a written response to the concerns outlined in
letters dated September 12, 2005 from Gilpin County via Petrock & Fendel, P.C. and the City of
Black Hawk via Hayes, Phillips, Hoffinan & Carberry, P.C.. The letters were addressed to Tom
Schreiner of the Division of Minerals and Geology. Copies of these letters have been faxed and
mailed to your office on September 14, 2005. The Division is requesting a written response to
the concerns listed in these letters as part of our evaluation of your application for a Regulaz 112
Operation. We request a written response on or before 1:00 P.M. today, September 16, 2005. If
