Long <br />Dreision Director <br />Re: Van 4 Shaft, Portion of Permitted Area of Thunderbolt Group, Existing Pernut M-77-287. <br />Dear Mr. Bates, <br />This office is currently nearing the end of its review of an application for a new l l0 permit for the Van 4 Shaft, <br />submitted by International Uranium (USA) Corp. As you are well aware, this new permit for IUC will eventually <br />replace Unretco's on that particular portion of the Thunderbolt Group permit. But there is no "mechanism" by <br />which our office may transfer only a portion of a permit area to a successor operator, which is the reason for their <br />new application. It is expected that the new permit (which is presently file no. M.A4~3,2) will be approved, since <br />most adequacy issues have been satisfied. e~ <br />1 ~ "~3L <br />The permit application submitted by IUC appears to be for exactly the same affected area as that currently defined <br />by Umetco's permit no. M-77-287. This agency does not issue more than one permit for any particular piece of <br />land, that is, overlapping permit aeeas aze avoided. While we may approve IUC's application for the Van 4 Shaft, <br />we cannot issue that permit to them until Umetco is approved for release from further reclamation on that specific <br />area. <br />A minor discrepancy exists regarding the exact "overlapping" of the affected areas of the two files. The affected <br />area defined by the upcoming permit consists of a 7.4-acre area at the production shaft and facilities location (which <br />appears to be the full limit of existing disturbance),.one 0.5-acre area at the existing vent shaft, and another 0.5-acre <br />area for a future vent shaft site. The total new permitted acreage will be 8.4 acres. The boundaries and features <br />depicted on Umetco's maps of the permitted area match nearly exactly, except that the stated acreage figures do not <br />match. Your permit area consists of 6.4 acres at the production shaft location, plus 0. l acre at the one vent shaft, <br />for a total of 6.5 acres. [f you have better information than that which I include here, please provide it. <br />A site may be approved for release only after a complete release request has been submitted by the operator and <br />approved by the Division. In order for IUC to obtain their permit, therefore, Umetco will have to submit a request <br />for release of that portion of the total permitted area (referred to as "partial release" or "acreage reduction" request), <br />pursuant to Hard Rock/Metals Rule 4.16. At such time that the application submitted by IUC is approved, Umetco <br />will be released without any undue delay or need for an inspection. <br />This letter is intended to inform you of the progress being made by IUC toward obtaining a DMG permit for that <br />site. Likewise, through the information in this letter, your release request may be made, in a timely manner as a <br />courtesy to IUC which may allow IUC to more promptly obtain said pennit. <br />con[ <br />
