F) It is the understanding of the Division that the operator will obtain a <br />dischazge permit from CDOH&E and depending on the fmal design of the <br />outfall structure, obtain a Nation Wide Permit from the US Anny Corps of <br />Engineers. If a permit is needed it has to be obtained prior to <br />commencement of mining activities. <br />G) On table G-1 water demand, the operator acknowledges that the 37-55 <br />acre-feet of water needed for the first 2 years are yet to be determined. <br />Prior to permit approval, the Division will need in place the appropriate <br />water supply substitute plan from the State Engineers Office. <br />VI) EXHIBITS "H", "I', "J' &"K" ADEQUATE <br />VTI} EXHIBIT "L" RECLAMTION COST <br />A) In order to properly calculate the needed reclamation, the Division needs <br />the actual size of the settling ponds and the conveyer structure proposed. <br />B) Since the operator does not have the substitute water supply plan, at <br />present, the Division will have to calculate the warranty needed to backfill <br />the pit azea to above the stated ground water level. According to the <br />borehole data, you have stated that the ground water level is <br />approximately 10 feet below the surface. Since you mining plan is going <br />to be approximately 25 feet below the surface, to backfill a 210-acre pond <br />to the required elevation a total of approximately, 5,080,983 cubic yazds of <br />material will be needed. Where will the material come from if you do not <br />get your water supply plan /the cost to backfill the pit is approximately <br />$3,000,000. Since the decision date for the application is 5/26/04, if the <br />operator does not appear to be able to obtain the needed approval for the <br />water substitute supply plan, before that date, it might be a good idea to <br />request a decision date waiver so we can change the decision date. <br />VIII) EXHIBITS "M."
