I!I IIIIIIIIIIIIIIII • • ~`~' ~~: ~_ <br />LAND RECLAMATION BOARD <br />Department of Natural Resources <br />. ?17, 1J45 Sherman St. Telephone: 842-3401 <br />..,.:,.r, Colorado 80203 <br />Guideline for Land Stabilization <br />and Reclamation Agreement <br />T:IIS AGREEMENT is entered into this ~_ day of September ~ <br />x;74 by and between THE STATE OF COLORADO, by and through its <br />Director of Natural Resources and the Land Reclamation Board <br />(::ereinafter referred to as "State") and DORN READY-MIX (herein- <br />,after referred to as "Dorn"). <br />W I T N E S S E T H: <br />i9HEREAS, Dorn desires to operate a sand and gravel mine in <br />portions of Section 33, Township 9 North, Range 57 West of the <br />6:.h P. M., Morgan County, Colorado, better known as the Barlow <br />?~.c; and <br />WHEREAS, Dorn has submitted a plan on the Proposed Land <br />~~abiiization and Reclamation Procedures for the proposed sand <br />a:d gravel pit operations; and, <br />L9HEREAS, said Barlow Pit will be operated for the purpose <br />o~ extracting sand and gravel for commercial marketing and, <br />WY.EREAS, the Colorado Open Mining Land Reclamation Act <br />_%=ovides statutory authority for the Land Reclamation Board of <br />~:e State of Colorado to enter into agreements with operators <br />~~ persons in charge of mining operations such as those contem- <br />:~~ced by Dorn to insure that the necessary stabilization and <br />-::clamation work will be done to prevent landslides, floods or <br />~~osion. This section of the law further provides that the <br />-„nd Reclamation Board requires a performance bond conditioned <br />..~.on the faithful performance of the stabilization work required <br />~: the Board; and, <br />WHEREAS, the Land Reclamation Board has determined that the <br />'.zing operation to be conducted by Dorn in said Section 33 <br />_..,:ld have an adverse effect on the environment and could result <br /> <br />
