This would consist of imparting clean, inert <br />backfill material to backtill the excavations to an elevation that is at leas'[ two (2) feet above the ground water <br />surface; importing topsoil to cover all backfilled areas to a depth of at least six (6) inches; and reseeding all <br />backfilled and graded areas. <br />Exhibit S -Permanent Structures <br />I) Rule 6.4.19 of the Construction Materials Rules and Regulations states: "Where the mining operation <br />will adversely affect the stability of any significant, valuable or permanent manmade structure located <br />within two-hundred (200) feet of affected land, the applicant may either provide a notarized <br />agreement between the applicant and the person(s) having an interest in the structure, that the <br />applicant is to provide compensation for any damage to the structure; or where such agreement cannot <br />be reached, the applicant shall provide an appropriate engineering evaluation that demonstrates that <br />such a structure shall not be damaged by activities occurring at the mining operation." <br />No agreements or analyses has been submitted at this time. Either compensation agreements must be agreed <br />upon with the land and structure owners shown on the Exhibit C map and listed in Exhibit S, a 200-Foot <br />setback must be preserved, or a detailed engineering geotechnical stability analysis must be submitted. [t also <br />appears that some of the structures on the Exhibit C Map, which are within 200 feet of [he mining limits have <br />not been included on [his list, including the Greeley Ttuck Washout facility. Please insure [ha[ all applicable <br />structures are addressed. <br />Please address these concerns prior to the currently scheduled due date of October 9, 2000.
