Susoension, or Revocation of PetTrtiLS By the Division (continued) (b) At the request of the permittce, the Division may modify or terminate this permit if the following conditions are met: (i) 1n the case of termioation, the permittce notifies the Division of its intent to terminate the permit 90 days prior to the desired date of termination and the permittce haz ceased any and all discharges to state waters and demonstrates to the Division there is no probability of further uncontrolled discharge(s) which may affect waters of u''tState. (ii) The Environmental Protection Agency has been notified of the proposed modification or termination and does not object in writing within thirty (30) days of receipt of notification; (iii) The Division finds that the permittce hrsshown reasonable grounds consistent with the Federal and State statutes and regulations For such modification, amendment or termination; (iv) Fce requirements of Section 6.16.0 of State Discharge Pemtit System Regulations have been mar and (v) Requirements of public notice have been met. 6. Oil and Ha~ardnus Suhstance Liahility Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittte from any • responsibilities, liabilities, or penalties to which the permittee is or may be subject to under Section 31 I (Oil and Hazardous Substance Liability) of the Clean Water Act. 7. State Laws Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the ptrmitttt frrnn :m}~ responsibilities, liabilities, or penalties established pursuant to any applicable State law or regulation under authority granted by Section Sl0 of the Clean Water Act. 8. Permit Violations Failure to comply with any terms and/or conditions of this permit shall be a violation of this permit. The discharge of any pollutant identified in this permit more frequently then or at a level in excess of that authorized shall constitute a violation of the permit. 9. Property Riehcs The issua:tct of this permit does not convey any property or water rights in tither real or personal property, or stream Flows, or any exclusive privileges, nor does it authorize any injury to private property or any invasion of person:+I ri_lus, nor any infringement of Federal, State or local laws or regulations. 10. Severahility The provisions of this permit art severable. If any provisions of this permit, or [he application of any provision of this permit to any circumstance, Is held invalid, the applicatiomof such provision to other circumstanets xnd the application of the remainder of this permit shall not be afkcttd.
