PART 11 <br />Papa 3~1 <br />Permit No. CO-0038776 <br />MANAGEMENT REQUIREMENTS <br />It shall not be a defense for a permittee in an enforcement action that it would be necessary to halt or reduce the <br />permitted activity in order to maintain compliance with the conditions of this permit. <br />12. Proper Ooerotion and Maintenance <br />The permittce shall at all times properly operate and maintain all facilities and systems of treatment and control (and <br />related appurtenances) which are installed or used by the permittce to achieve compliance with the conditions of this <br />permit. Proper operation and otaintepance includes effective performance, ode-auate funding, adequate operator staffing <br />and twining, and adequate laboratory and process controls, including appropriate quality assurance procedures. This <br />provision requires the operation of back-up or auxiliary facilities or similar systems ottly when necessary to achieve <br />compliance with the conditions of the permit. <br />B. RESPONSiBi[.ITIES <br />1. Incyectipns and Rieht to Entrv <br />The permittce shall allow the Director of the Division and/or the authorized representative, upon the presentation of <br />credentials: <br />a) To enter upon the permittee's premises where a regulated facility or activity is located or in which any records are <br />required to be kept under the terms and conditions of this permit; <br />• b) At reasonable times to have access to and copy any records required to be kept under the terms and conditions of <br />thi+ permit and to inspect any monitoring equipment ar monitoring method required in the permit; and <br />c) To inter upon the petmittee's premises in a reasonable manner and at a reasonable time to inspect and/or <br />investigate, any actual, suspected, or potential source of water pollution, or to ascertain compliance or non <br />compliance with the Colorado Water Quality Control Act or any other applicable state or fedewl statute or <br />regulation or any prder promulgated by the Division. The investigation ma)• include, but is not limited to, the <br />following: sampling of any discharge and/or process waters, the taking of photogwphs, interviewing of any parson <br />having knowledee related to the discharge permit or alleged violation, access to any and all facilities or areas within <br />the penrtittee's premises that may have any affect nn the discharge, permit. or alleged violation. <br />d) The Division shall split samples taken by the Division during any investigation with the permittee if requested to du <br />so by the permittee. <br />2. Dutv Ut Provide InfntTrtatiim <br />The permittee shall famish to the Division, within a raa_sonablz time, any information which the Division may request to <br />determine whether cause exists for modifying, revoking and reissuing, or terminating this permit, or to determine <br />compliance with this permit. Tha permittee shall also famish to the Division, upon request, copies of records reyuircd <br />to he kept by this permit. <br />3. Trmnsf'er of Ownership nr Control <br />A permit may be transferred [n a new permittee only upon the completion of the following: <br />• a) The current permittee no[ifies the Division in writing 30 da}'s in advance of the proposed transfer da[e; and <br />b) Tha notice includes a wntten agreement between the existine and new permittees containing a specific date for <br />transfer of parmit responsibility, coverage and liahility between them; and <br />c) Fee requirements of the State Dischar;e Pern°it System Rr_ulatinns.
