Ol l and 013 Icontinuedl <br />(i) Toxicity has been demoastrared in the efflurnt and the permit don not wntaia a toxicity limitation. <br />(ii) The PTVflE vaults indicate that the toxicant (s) represem pollutant(s) thaz may be controlled with specific <br />numerical limits, and the Division agrees that the aumaical controls ate the most appropriaze course of <br />action. <br />(iii) The P'flrl'IE reveals other unique conditions or rharacuristics which, in the opinion of the Division, justify <br />the incorporazion of unanticipazed special conditions is the permit. <br />4. Chronic WET Testine - Ontfall 012 <br />(a) Tatine and Reoortin¢ Reouircments <br />Tests shall be done at the freauencv listed in Part I.B.1. Tat faults shad be repotted on the Discharge <br />Monitoring Report (DMR) submitted for the reporting period during which the sample was taken. (i.e., WET taring <br />vaults for the first calendar quarter ending Match 31 shall be teponed with the DMR due April 28.) The results <br />shall be submitted on the Chronic Toxicity Test report form, available from the Division. Copies of shoe reports <br />are to be submitted co both the Division and EPA along with the DMR. <br />The petmittee shall conduct each chronic WET tat is general aaordance with methods dactibed Short Term <br />Methods for Estimative the Chronic Toxicirv of Effluents and Receivine blazers m Freshwater Oreanisttu, <br />EPAl600l4-89/OOI or the most t:urtrnt edition, except as modified by the most rnrrrnt Division guidance document <br />entitled S3uidelina for Conductive Whole Effluent Toxicirv Tars. The permitter shall conduct such tau using <br />Ceriodaphnia dubia and fathead minnows. <br />(b) Failure of Test and Division Notification <br />Beginning on the effective daze of this permit, a chronic WET tat is failed whenever there is a statistically <br />significant difference in lethality between the control and any effluent wnaatration less than or equal to the <br />instream waste eonerntrazion ('IWC"). The IWC for this permit has been determined to be 10090. The permittee <br />must provide writtrn notification of the failure of a WET tat to the Division, along with a stazement as [o whether a <br />Preliminary Toxicity [nvatigatiaa ('PTI')lCoxiciry Idrntifira[ion Evaluation ("TIE") or accelccated rating is being <br />performed. Notifiption must be received by the Division within 21 ralmdar days of the demonstration of <br />chronic WET in the routine required tat. 'Demonstration' for the purpose of Parts I.B.4(b),(c),(d), (e) and (g) <br />means ao later than the last day of the labotazory ta[. <br />(c) Automatic Compliance Schedule Uoon Failure of Tat <br />If a routine chronic WET tat is failed, the following automatic compliance schedule shall apply. As pan of this the <br />perntittee shall either: <br />(i) proceed [o conduct the IYI'IlfIE investigation as described in Pan I.B.4.e, or <br />(ii) conduct accelerated taring string the single specie found to be more sensitive. <br />If accelerrted [acing is being performed, the permittee shall provide written notification of the results within <br />14 plendar days of completion of the "Pattern of Toxicity"1"No Toxicity" demonstration. Ta[ing will be at <br />(east once every two weeks for up to five tats until; 1) two consecutive cats fail or three of five tau fail, is which <br />case a pattern of toxicity has been demonsaaud or 2) two wnsecu[ive arcs pass ar three of five tars pass, in which <br />case no pattern of toxicity has been found. <br />Amendment No. 2 Issued FEB 1 9 1997Eff«tive APR 0 1 1997 <br />~. <br />
