Miller, Chief <br />Regulatory Branch, Operations Division <br />Department of the Army <br />Omaha District, Corps of Engineers, Permit Branch <br />Box 5 <br />Omaha, NE 68101 <br />Dear Mr. Miller: <br />Re 404 Permit Requirement - Request for Opinion <br />We are preparing a Colorado Mined Land Reclamation permit application <br />for J-Bar-B, Inc. It is our client's intention to excavate gravel <br />on both sides of St. Vrain Creek in an area about eight miles <br />southwest of the location where the St. Vrain joins the South <br />Platte River. More specifically, mining will occur on parts <br />of the S/2 NE/4 and SE/4, Section 36, Township 3 North, Range <br />68 West, 6th P.M., Weld County, Colorado. <br />The operator does not intend to mine in St. Vrain Creek. In <br />fact, excavation will be set back 100 feet from the creek. The <br />setback will be used exclusively for temporary stockpiling of <br />soils and aggregates and for access roads within the confines <br />of the operation. <br />There are three or four small areas on the property on which <br />reeds and cattails grow. Two of these small areas will not be <br />affected by the mining activity. The other one or two areas <br />will be mined out and will become part of the pond system shown <br />on the enclosed map. The operator plans no fill operation of <br />any kind. <br />We have reviewed the Permit Program booklet and pamphlet and <br />it is our conclusion that a 404 permit is not necessary for this <br />operation. However, in order to satisfy various state and county <br />agencies, we are requesting an opinion from your department. <br />If you have any questions, please call us at the <br />above.
