Steve Nguyen <br />March 21, 2007 <br />Gould Farm <br />The Gould farm was historically irrigated using 2 shares of the Rural Ditch of which Weld <br />County owns 1 share. The 2 shares were historically used to irrigate 55 acres of corn, all of <br />which has been taken out of production. The historic consumptive use of the 2 shares was <br />determined to be 66.4 acre-feet. The prorata historic consumptive use for 1 share is 33.2 acre- <br />feet. <br />The Villa Property <br />The Villa Property was historically irrigated using 1.5 shares of the Rural Ditch owned by <br />Weld County. The 1.5 shares were historically used to irrigate 27 acres of corn and 27 acres of <br />Pasture grass, all of which has been taken out of production. The historic consumptive use of <br />the 1.5 shares was determined to be 61.7 acre-feet. <br />Slovek Prooe <br />The Slovek Property was historically irrigated using 1 share of the Rural Ditch of which <br />Weld County owns 0.25 shares. The 1 share was historically used to irrigate 30 acres of corn <br />and 30 acres of Pasture grass, all of which has been taken out of production. The historic <br />consumptive use of the 1 share was determined to be 50.5 acre-feet. The prorata historic <br />consumptive use for 0.25 shares is 12.6 acre-feet. <br />A monthly breakdown of depletions and replacements is shown on the attached Table <br />No. 8 that was submitted with your report. <br />Conditions of Approval <br />I approve the proposed substitute water supply plan in accordance with Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />This SWSP shall be valid for the period of April 1, 2007 through March 31, 2008, unless <br />otherwise revoked, modified, or superseded by decree. If this plan will not be made <br />absolute by a water court action by the plan's expiration date, a renewal request must be <br />submitted to this office with the statutory fee (currently $257) by February 1, 2008. <br />2. Anew well permit must be obtained for the gravel pit in accordance with §37-90-137(2) <br />and (11), C.R.S. prior to expanding the irrigation consumptive use at the pit beyond the <br />amount currently permitted under well permit no. 63693-F. Any application will be <br />evaluated subsequent to approval of this plan. The provisions of §37-90-137(2) prohibit <br />the issuance of a permit for a well to be located within 600 feet of any existing well, <br />unless the State Engineer finds that circumstances so warrant after a hearing in <br />accordance with the procedural rules in 2CCR402-5. The hearing will be waived if you <br />are able to obtain statements from the owners of all wells within 600 feet, verifying that <br />they have no objection to your use of the proposed well. Shoufd a new well permit be <br />denied for reasons of the 600-foot spacing, or any other legitimate reason, approval of <br />this amendment will be canceled. <br />
