Colorado Mined Land Reclamation Act 34-32-114, <br />Paragraph 4 (a) requires that the board not deny a permit, <br />except for one or more of the following reasons: <br />(a) the application is incomplete ... <br />Specifically refering to 34-32-112 Paragraph One, A complete <br />apF~lication shall consist oP sub-paragraph (a) through (h). <br />Said application is incomplete and unavailable for public <br />inspection in the Clerk and Recorders office in La Plata <br />County. This failure constitutes grounds for automatic denial. <br />6. By Legislative Declaration (34-32-102) "It is declared <br />to be the policy of this state ... to conserve natural resources <br />... and to protect and promote health, safety and general <br />welfax•e of the people of this state." <br />At the location specified in said application, a gravel <br />mining operation has been conducted illegally by the applicant <br />without consideration for the general welfare of the residents <br />of the immediate community. <br />The items that have been a detriment to the health, safety <br />and general welfare of the affected residents Snclude: <br />1. Harmful air pollutants (i.e. dust and exhaust fumes) <br />2. Excessive noise levels <br />3. Excessive vibrations <br />4. Scattered refuse on and off of the affected land <br />5. Destruction of land with no reclamation <br />6. Increased traffic <br />7. Creation of a potentially dangerous slide area <br />It is our contention that this gravel mining operation <br />should never be allowed to reopen and that the State of <br />Colorado should enforce existing regulations to require the <br />owner and applicant to immediately reclaim the affected land. <br />Your consideration is appreciated on this protest and <br />pet:~tiun for hearing.
