<br />Special Conditions: <br /> <br />The permittee shall provide a bond in the amount of $3,000.00. This bond must be <br />maintained in effect until removal of improvements and restoration of the permit azea have <br />been accepted by the authorized officer. <br />2. The permittee agrees that all monies deposited with the authorized officer as security for <br />permittee's performance of the terms and conditions of this grant may, upon failure on the <br />permittee's part to fulfill any of the requirements herein set forth or made a part hereof, be <br />retained by the United States to be applied as far as may be needed to the satisfaction of the <br />pennittee's obligations assumed hereunder, without prejudice whatever to any other rights <br />and remedies of the United States. <br />3. Should the bond delivered under this grant become unsatisfactory to the authorized officer, <br />the permittee, shall, within 30 days of demand, furnish a new bond. <br />4. The permittee shall contact the authorized officer at least 5 days prior to the anticipated start <br />of construction and/or any surface disturbing activities. The authorized officer may require <br />and schedule a preconstruction conference with the permittee prior to the permittee's <br />commencing construction or surface disturbing activities on the permit area. The permittee <br />and/or his representative shall attend this conference. <br />5. The permittee shall ensure that the well construction is carried out by a licensed driller. <br />6. The permittee shall submit to the BLM, Gunnison Field Office well log(s) of the permitted <br />well construction afrer construction is completed. <br />The permittee shall submit to the BLM, Gunnison Field Office all water quality analysis <br />records of water samples from the permitted well(s). <br />Upon expiration, cancellation, or relinquishment of the land use permit, the permittee shall <br />plug and abandon the well by completely filling the well to the land surface with cement. <br />Phis is in addition to the State's requirements for plugging and abandoning wells (Rule 16 of <br />the Water Well Construction Rules). <br />9. The permittee shall conduct all activities associated with the operation, maintenance and <br />termination of the land use within the authorized limits of the land use permit. The permittee <br />shall, to the extent feasible, preserve plant life and other natural features within the permit <br />area. <br />10. The permittee shall comply with applicable State standards for public health and safety, <br />environmental protection and siting, construction, operation and maintenance, if these State <br />standards are more stringent than Federal standards for similar projects. <br />11. No construction activities shall be performed during periods when the soil is too wet to <br />adequately support construction equipment. If such equipment created ruts in excess of 3 <br />inches deep, the soil shall be deemed too wet to adequately support construction equipment. <br />12.
