Dear Mr. Carter:
With this submittal, we are requesting that the Division of Minerals and Geology (DMG)
approve a Notice of Intent (NOI) for completion of the Elk Creek Exploration Program. The
exploration program involves completion of up to 12 exploration drillholes; collection and
analysis of core samples from these drillholes to characterize the D coal seam, associated roof
and floor materials, and geotechnical conditions; and trenching to locate and delineate the D
seam outcrop in the Elk Creek Valley.
This NOI application submittal consists of the following components:

Please note that this submittal is sepazate documentation from the existing approved DMG
Mining and Reclamation Plan document. In conjunction with our development of the PR-04
permit revision and permit re-organization, however, we will incorporate much of the general
language describing exploration activities in Section 2.02 and will provide for insertion of this
and any future NOI's in a permit exhibit, Exhibit 2.04-E3, Geologic Information. Please
