Ryan & Son, Inc. - File No. 83-139 <br />Dear Mr. Rindahl: <br />In response to your correspondence of December 3, 1984 to Mark Loye, the <br />Division has thoroughly reviewed this file. This review has revealed a number <br />of points: <br />1. July 15, 1983 - Application received by Division. <br />2. September 12, 1983 - Memorandum from Jefferson County specifying <br />operation is not in compliance with County <br />zoning. <br />3. September 14, 1983 - Objection letter received from Fairmount <br />Improvement Association. <br />4. January 31, 1984 - Indefinite continuance granted by the Mined <br />Land Reclamation Board due to lack of County <br />zoning. <br />It is the Division's position that since a tremendous amount of time has <br />elapsed since the continuance was granted and since there was an objection <br />raised to this operation, the operator needs to redo the notice procedures as <br />addressed pursuant to Rule 2.2 of the Rules and Regulations. <br />The Division will handle this newly reactivated application as if it was a <br />brand new application with you being sent the enclosed "Complete Letter" and <br />Jefferson County being sent a notice memorandum.
