Long <br />, <br />1005 N. 12th St. #211 Dimsion Director <br />Grand Junction, CO 81501 <br />Re: Roaring Fork Resources' Mamm Creek Sand & Gravel, File No. M-2000-113, Receipt of 112 <br />Construction Materials Reclamation Permit Application Package <br />Dear Mr. Balaz: <br />On September 8, 2000, the Division of Minerals and Geology received your 112 Construction Materials <br />Reclamation Permit Application package for the Mamm Creek Sand & Gravel, File No. M-2000-113. <br />Preliminary review of the information received detemtined that the following items must be received before the <br />Division can consider your application as being submitted and technical review can begin: <br />Apolication and Exhibits - Aoolicant/Operator Name: The Applicant/Operator Name on page 1, 3, <br />and 7 in the application form is listed as Roaring Fork Resources. The Corporate Seal on page 7 of the <br />application is for a corporation by the name of Roaring Fork Resources, Inc. Exhibit N -Legal Right- <br />to-Enter says Roaring Fork Resources has the agreement with 1im and Jean Snyder the landowner. The <br />actual agreement shows that the agreement is between Jim and Jean Snyder and a corporation called <br />Roaring Fork Resources, inc. Exhibit S -Permanent Man-made Structures, License TSL-3817- <br />000801 is between Tri-State Generation and Transmission Association, Inc. and Roaring Fork <br />Resources, Inc. The name of the ApplicanUOperator must be consistent in all documents. If Roaring <br />Fork Resources is to be the ApplicanUOperator then the Division cannot accept any documents in <br />Roaring Fork Resources, Inc.'s name since this is a registered corporation with the Colorado Secretary <br />of States office. Roaring Fork Resources and Roaring Fork Resources, Inc. are considered to be <br />different. One is a company and the other is a corporation. The applicant/operator must choose which <br />name they wish to do business under and then change all of the appropriate documents to be consistent. <br />EXHIBIT N -Source of Le2a1 Right to Enter (Rule 6.4.141: You must provide the source of your <br />legal right to enter and initiate a mining operation on the affected land. New lease may be necessary to <br />change to Roaring Fork Resources. <br />EXHIBIT R -Proof of Filing with Coun~Clerk and Recorder~ule 6.4.18): You must submit an <br />affidavit or receipt indicating the date on which the application was placed with the local County Clerk <br />and Recorder. The Division needs a copy of the Certified Mail Receipt showing the date that the <br />County Clerk and Recorder received the application for public review. <br />
