Recordkeeain2 (sicl and Renortine <br />b. Annual Report for Active Mining Operations <br />1) Mountain Coal Company's `Jest Elk Mine has in-place a Storm Water Management <br />Plan (SWMP). Using Best Management Practices storm water is diverted away from <br />material handling facilities and where necessary, the storm water is otherwise diverted, <br />conveyed, and collected by sedimentation control devices. Where the storm water is <br />collected, the operation is in compliance with the terms of Mountain Coal Company's <br />CPDES requirements of Permit No. CO-0038776. Best Management Practices in effect at <br />the mine also include Spill Prevention Control and Countermeasure plan and procedures, <br />preventative maintenance, good housekeeping, and assessment of the potential pollutant <br />sources. In addition, the West Elk Mine is inspected by the Colorado Division of Minerals <br />and Geology, Office of Mined Land Reclamation. The inspections of the operation are <br />completed by qualified personnel at a frequency that exceeds the twice yearly requirement. <br />Therefore, we believe that overall compliance with the SWMP is being achieved. <br />2) The name of the permittee, address, phone number, and permit certification number <br />are as follows: Mountain Coal Company, West Elk Mine; P.O.
