Banta, <br />APPLICATION PACKAGE Division Oireoior <br />Applicability <br />This application package is for a mining operation affecting less than 10 acres and <br />extracting less than 70,G00 tons of mineral, overburden or combination of the two per <br />calendar year. If you plan to conduct a mining operation which meets these criteria, <br />please follow the instructions provided in this package and Rule 3.2 in the Mineral <br />Rules and Regulations. <br />Filing Requirements <br />the Mineral Rules and Re-3ulations (the Mined Land Reclamation Act, 34-32-101, et se ., <br />C.R.S., and 2 CCR 401-1) of the Colorado Mined Land Reclamation Board (the "Board") <br />regulate the permitting, operational and reclamation requirements for ail non-coal <br />mining operations in Colorado. It is your obligation to comply with the Act and <br />Regulations. You are encouraged to obtain and revie cony of the Rules, available for <br />$2.00 from the Mined Land Reclamation Division (the "Division"). In order to submit <br />your application properly, it is recommended that you review the Act and: <br />Rule 1 Defiritions and General Provisions; <br />Rule 3.2 Permitting Requirements for Limited Impact Mining Operations; <br />Rule 6 Recl~lmation Performance Standards; <br />Rule 7 Requirements for Performance and Financial Responsibility; and, <br />Rule 8.2.1 Operating without a Permit - Penalty <br />To apply for a Reclamation Permit for a Limited Impact Operatfion; two (2) copies <br />Limited Impact Operation (110(2)) Application Form, Exhibit A-J a lcation fee <br />must be submitted to the Division. This package contains t e required application form <br />and instructions for preparing Exhibits A-J. <br />Prior to submitting the_ implication to the Division for filing, send a notice on a form <br />approved the Board, Eo t~oca oar o county comm ssloners an 1f the mihing <br />operation is w1- t'-Tirothe boundaries of a soil conservation district, to the board of <br />supervisors of the sot. conservation district. A copy of these "Notice of Filing <br />Application" forms have-been attached for your use.
