THIS PERMIT is issued by the Mined Land Reclamation Board, Departrnart of Nahual Resources,
State of Colorado.
RECITALS
A. The Pemmittee, City of Walsenburg, desires to conduct a mining operation ]mown as
Walseamburg Gravel Pit, for the purpose of extradumg sand and gravel. The Permittee will not mine any secondary
commodities.
B. On December 14, 2000 the Mined Land Reclama[i~ Board (the "Board") approved the
Permittee's application for this permit and directed that this pemmit be issued upon the Slurg with the Division of
Minerals and Geology (the "Divisiar") of performance warranty approved by the Division. Said waraMy has
been Sled with the Division.
C. If the Pernitfee desires to emQract materials other than those listed m (A), a separate pemmit may
be required.
D. On December 14, 2000 the Board made the following Sndmgs:
1. The application for this permit corrmplies with the requirements of the Colorado Mined
Land Reclamation Act for the Extraction of Construction Materials, C.RS. 34-32.5-101 eY sue., as amended, and
with all apphcable local, state and fi~eral laws;
2. The operation will nd adversely affect the stability of any signiScant, valuable, and
permanent nmarr-made structure located within two hrmdred fed of the Affected Land, except where there is an
agrcement between the Operator and the persons having an irmterest um the stnrdure that damage to the structure is
to be compensated for by the Pertnittee; and;
