1 i • <br />STATE OF COLORADO ) <br />ss A F F I D A V I T <br />COUNTY OF HUERFANO ) <br />FRANK M1tALDONADO, of lawful age, being first duly <br />sworn upon his oath deposes and states as follows: <br />That he is the owner of certain real estate lying <br />north and west of a small piece of land owned by <br />Ephriam Vehill on Sand Arroyo in Huerfano County, Colo- <br />rado, and on his lands there is a gravel pit and sand <br />pit which has been mined for thirty or forty years; <br />that he himself has been owner of this real estate, and <br />that no complaints have ever been filed with him critic- <br />izing the sand and gravel operation. <br />That he drives to his lands over a road passing <br />through the Vehill lands and has done so for more than <br />twenty-one years without permission, and without ob- <br />jection from Mr. Vehill or anybody else; that he has <br />owned his own lands for approximately _~,~ _ years. <br />That I personally know that the road traversed <br />here in question, has been in existence and used by the <br />public for forty years; and that Adams Maldonado uses <br />this road to reach his own lands, and he states that <br />the road has been in use for more than sixty years. <br />That in the late 1950s, Vehill complained to the <br />County Commissioners about this read, and was told by <br />the Commissioners and the County Attorney that he had <br />no right to close this road, and since that time, Vehill <br />has made no objection to any local persons about the road. <br />FURTHER, AFFIANT SAYETH NAUGHT. / ~/ <br />Subscribed and sworn to before me this /~l~~_day of January <br />1979. ~ <br />Z~-vU~ ~,(~L,v~~c~G+yl--c,~(c~ <br />Notary Public <br /> <br />i~ ~~ y ~i <br />y-'.a t ~ ~ r ~ Y <br />
