Fonds P1 and P17 were discharging a small amount of <br />water and showed evidence ttlat recent precipitation <br />events had caused recurring discharges. <br />2. Pond P20 had no additional storage capacity available. <br />Any discharge of wastewater from the reclamation ponds is in <br />violation of Section 25-8-501 of the Colorado Revised <br />Statutes which states, "iJo person s~~ail discharge any <br />pollutant into any state water from a point source laithol.lt <br />first having obtained a permit fx•om the division for such <br />discharge...". Since your previous discharge permit was <br />revolved, you should consider applying for a new one. Copies <br />of the applicable permit application form and general permit <br />for coal mining facilities have been sent to Greg Lewicki by <br />separate mail. <br />This letter is a notice of violation of Section 501 of the <br />Colorado Water Quality Control Act and requires a response, <br />in writing, no later than Octobar 21, 1991. lour response <br />should outline your planned course of action to bring about <br />compliance. <br />Ci Vnni.Ann .r~al.JpuVu <br />
