<br />W I T N E S SETH
<br />WHERE , Sturbaum Construction desiree to conduct a(n) open mining
<br />operation, own as Burnito Quarry d , for the purpoee of extracting sand b gravel
<br />mined open pit Sturbaum Pit
<br />ganister quarry
<br />WHEREAS, on August 30 1977 , "FILED" an appli-
<br />cation, a reclamation plan and mzp, and the required fee, as required by law; and
<br />WHEREAS, on November 22 , 1977 , the Alined hand P,r•ulamation Board approved
<br />open mining application and set bond; and
<br />WHERt,AS, or, November 22 i'+77 , the Aimed Land Reclamation Board accepted sarety
<br />submitted by Sturbaum Construction and sudr date shall be considered the
<br />date of issuance of the hermit and the anniversary date for all other purposes; and
<br />WHEREAS, the !lined La,td Reclamation Buard has made a finding, far the purposes
<br />of issuing this permit, that:
<br />1) the application cempl'es with the requirements of the Colorado
<br />Mined Land Reclamation Act and a7.1 applicable local, state e.nd
<br />Federal laws; and,
<br />2) the operation will ,:ot adversely affect t.i:e stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred f<et of the affected land, e.~:cept where there
<br />is an agreement. o'~i '~~n the operator and the persons having an
<br />interest in the atr,~crur^_ that drmage to the structure is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining ~pccacions and reclamation con be carried out
<br />in cenforma::ce with the requirements of C.R.S. 1973, 34-32-:L16,
<br />as amended (1976 Sess. Laws EL B. 1065); and
<br />WHEREAS, Eor [he purp.^sen of i:suing this permit, [he operator has made
<br />a satisfactory shrnainQ to [k,e Buard that he will ~:n:ploy during and after his
<br />mining operations procedures reasonably designed to minimi:.e
<br />as practicable the ut~ruptiort from the open pit mining operations and will
<br />provide For the rehabi.itation of the affected land through the rehabilitation of
<br />cover, soil stability, ::stet re;our.ce:~, and other ,neasures appropriate to the
<br />subsequent heneEicial use of sur_lr mine.! and recl,ti.rred lands; and that in
<br />the event of the failur.~ of hit, proposed reclamation plan, he will take whatever
<br />measures which may be necessar} in orSer [o assure the success of reclamation of
<br />the lands affected by Isis open pit minir:g operations; and,
<br />WHEREAS, for the purposes of issuing this permit, a copy of the application

<br />NOW, THEREFORE, pursuant to the nu!horlty set. forth in the Colorado Afined
<br />Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, (1976
<br />Sass. Laws H.B. 1055) the Afiaed Land Rec.lamatinn P,oard of the State of Colorado
<br />hereby issues a life of the miss permit to Sturbaum Construction to engage in
<br />open pit mirrin{; for the purpose of e:ctraccing
