• <br />2.04.7 (2) Surface Water Information <br />Water Rights <br />Attachment f[I, page 3 - 24, Includes a list of water rights in the ~ <br />general area, oonplete with priority dates, locations, and amounts. <br />This Ilsting was excerpted from the official State Engineer's tabulation <br />for Water Division 2, District 12, and includes a number of water rights <br />which had been changed by Civ(1 Action 2637, Frertunt County District <br />Court, November 24, 1915. Through condemnation and purchase, the City <br />of Florence acquired title to the following water rights on Newlin <br />Creek: <br />Jane R. Smith Right <br />Seth Wright Ditch No. 1 <br />• Seth Wright Ditch No. 2 <br />August Wasnuth Right <br />Arkansas River Priority, N34 <br />Arkansas River priority, M283 <br />In assembling these rights Into a single package, the Court awarded to <br />the City of Florence "the entire natural flow of water In said Newland <br />Creek, for and during the spring and sumrer Irrigating season, of each <br />year." To provide a year-rand supply, Che Court also Included Che <br />amount of 5.0 cfs 'tivhenever the same may be In Bald creek, including the <br />flood waters of said creek, to be diverted by and conveyed through the <br />Florence Pipe Line." The City of Florence thus rertoved competition from <br />the Newlin (a/k/a Newland) Creek drainage. A current list of Newlin <br />Creek active water rights would include only the Florence diversions <br />(see Figure 2.04.7 Clc) and the Hydrology Map, Sheet 1, for locations) <br />and the Corely and Thompson wells Csee Table 2.04.7 (1)). <br />• Diversion by the City of Florence <br />Two structures were built by the City of Florence prior to 1916 <br />Cprobably beglming as early as 1878) for the purpose of collecting the <br />,~ <br />
