This Board has jurisdiction over the parties and the subject matter of this proceeding <br />pursuant to Section 34-32.5-114 of the Colorado Mined Land Reclamation Act for the <br />Extraction of Construction Materials, Section 34-32.5-101 et seq., C.R.S. (2004) (the <br />"Act" <br />5. The Board's prehearing conference officer held a prehearing conference on August 20th, <br />2004 in Trinidad, Colorado. None of the objectors appeared at the prehearing conference. <br />They thereby lost their party status pursuant to Construction Materials Rule 2.7.3(4). <br />6. Because of concerns about the potential for Native American burial sites in the area, the <br />Division asked the Applicant to conduct a Class III archaeological survey of the site. The <br />survey resuhs indicated there were no burial sites within the permitted area. <br />7. The weight of the evidence indicates the Applicant has complied with the minimum <br />requirements of the Act. <br />
