Phase I THE (continued) <br />If the Phase I THE identifies a probable toxicant and/or a probable <br />source of toxicity, the permittee shall submit written notification to <br />that effect to the Division as part of the report. Within 30 days of <br />submission (date of receipt) of the Phase I TRE, the permittee shall <br />submit (date of receipt) for the Division's approval a control grogram <br />to control WET, and shall proceed to implement such plan within 7 days <br />following receipt of written approval from the Division. <br />If the Phase I THE fails to identify a probable toxicant and/or a <br />probable source of toxicity, the permittee shall notify the Division of <br />its findings and proceed with the Phase II TRE. <br />If toxicity disappears during the Phase I TRE, the permittee shall <br />submit written notification to that effect to the Division. The <br />Division may require the permittee to conduct accelerated testing to <br />demonstrate the continued absence of toxicity. If, after completing any <br />Division directed accelerated testing, no acute toxicity is found to <br />exist, the permittee shall resume normal quarterly testing. <br />8. Phase II THE <br />A plan for a Phase II THE shall be submitted (date of receipt) to the <br />Division by the permittee within 60 days of the submission (date of <br />receipt) of the Phase I THE Report. The Phase II TRE, as submitted to <br />or revised by the Division, shall be incorporated into the permit as a <br />modified compliance schedule. <br />The Phase II THE plan shall include the scope, methods, procedures, <br />reporting requirements, and schedules. A Phase II THE may follow either <br />of two directions, as appropriate: toxicant treatability studies, or <br />toxicant/source identification and control studies. Toxicant <br />treatability studies are designed to assess the feasibility of <br />eliminating WET via addition or modification of treatment processes at <br />the wastewater treatment facility. <br />Toxicant/source identification and control efforts are designed to <br />identify toxicants, identify the sources of toxicants, and control whole <br />effluent toxicity by eliminating the introduction of toxicants into the <br />wastewater treatment facility. Toxicity identlfication studies <br />performed by the permittee shall be in general accordance with accepted <br />methods for Toxicity Identification Procedures and Toxicity Confirmation <br />Procedures. The Phase II THE permit conditions may be amended, if so <br />requested and justified by the permittee. <br />The Phase II THE report shall indicate the results of the Phase II THE <br />study. If the Phase II THE results in the identification of the <br />toxicants, the sources of toxicants or treatment for elimination of the <br />toxicant, the permittee shall submit for Divisioa approval a control <br />program to control WET within 60 days of submission (date of receipt) of <br />the Phase II THE Report, and shall proceed to implement such plan within <br />7 days following receipt of written approval from the Division. <br />
