Taylor <br />382 Denver Club Building <br />518 17th Street <br />Denver, Colorado 80202 <br />RE: Fondis Pit, (File No. M-88-101) <br />Dear Mr. Taylor: <br />In response to your November 5, 1990 correspondence, I would like to take this <br />opportunity to clarify the status of the Fondis Pit permit. On September 14, <br />1990, the Division inspected the Fondis Pit. Subsequent to the inspection, a <br />report detailing three (3) required corrective actions was issued. Copies of <br />the inspection report were sent to Elbert County and to yourself. The report .. <br />required Elbert County to submit a revision to the approved permit which would <br />address pit outslope stabilization, inclusion of the haul road in the permit <br />area, provide culvert sizing calculations such that the 25 year, 24 hour storm <br />event could be conveyed, and address repair of the haul road crossing. <br />Elbert County was also notified that drainage, specifically that near the <br />northwest corner of the pit, mist be directed into the pit. The County was <br />also requested to submit information which substantiated the use of the <br />24 inch culvert at the failed haul road crossing. The pit drainage problem <br />was to be corrected, and the revision application and culvert discussion were <br />to be submitted by November 1, 1990. <br />Elbert County has represented to us that the drainage problem was corrected by <br />November 1, 1990. The County did supply us with a revision to the approved <br />plan which addressed inclusion of the haul road and appropriate culvert and <br />stream crossing design criteria on November 1, 1990. We are currently <br />reviewing the proposed revision. A copy is available for review at our <br />offices and at the Elbert County Courthouse. <br />We are processing the permit revision, and will establish specific <br />stabilization and water conveyance methods and timeframes in the context of <br />the revision. We welcome your comments in this matter. <br />As we discussed by telephone on October 23, 1990, and in our May 16, 1990 <br />correspondence to you, the Board may revoke a permit only after a violation <br />has been issued. <br />
