.w•

Mr. Frank M. Graham, Jr.
January Z3, 1982
Page -5-
more than one 40-acre phase of the mining operation will be disturbed to some
extent at any one time. The haul road must also be included as disturbed
acreage. An analysis of the total disturbance based on major, moderate and
minor disturbance levels (as defined in Rule 2.12(9) d.) should help to
minimize the bond amount.
3. Please revise your reclamation costs after consideration of the items
relating to total disturbance and potential added expenses as discussed in
this letter.
Exhibit N
It seems to me that a fugitive dust permit will be required for this operation.
I suggest that you contact the Colorado Department of Health in this matter.
A copy of the application for this permit (and, la ter ,proof of its approval)
should be submitted to our Division.
Exhibit O
The enclosed copy of the deed to this property is supposed to have an
~~ attached Segal description as Exhibit A. This was not included with
the copy of the deed to the property. This makes it impossible to
evaluate the property to which the deed refers.
I have tried to be comprehensive in my review of this application. If you
have any comments or questions concerning this letter, please call me. I"
feel that we should be able to be ready for the February 29-25 Board meeting
(to be held in Room 110 of our building).
Sincerely,

Mark S.
