• Introduction <br />The embankment and spillway structures of Sedimentation Pond 006 was constructed in the <br />fall of 1989 and according to the designs contained in the approved permit (see Appendix <br />7-8 and 7-BA). The as-built conditions of these structures are shown in Exhibit 7-13B. <br />This certification covers the embankment area and spillway structures of Sedimentation <br />Pond 006. <br />Construction Summary <br />In accordance with Rule 4, Part 4.05.6(7) of the Rules and Regulations of the Colorado <br />Mined Land Reclamation Board pursuant to the Colorado Surface Coal Mining Reclamation Act <br />34-33-101 et seq., 1, Ronald J. Cehr ke, hereby certify that the construction of <br />Sedimentation Pond 006 embankment was inspected and constructed under my supervision. <br />From September 20 until September 21, 1989 during construction, I was on site to inspect <br />the construction of this structure. The construction was supervised on site by Rey <br />A rmijo, a graduate civil engineer and Operations Engineering Manager at the Seneca II <br />• Mine. Rey assured all work was performed in accordance with the design and the <br />specifications. I inspected the completed structure on November 7, 1989 and again on May <br />22, 1990 to verify the as-built conditions. I, Ronald J. Gehrke, am a 1977 graduate in <br />civil engineering and I have been a Registered Professional Engineer in Colorado since <br />November 22, 1982. <br />The purpose of my inspection and certification was to ensure proper construction of <br />Sedimentation Pond 006 embankment and spillways and to satisfy the requirements of Rule <br />4.05.6(7) of the Colorado Mined Land Reclamation Division. The material was placed in the <br />embankment to meet or exceed the design specifications (see Appendix 7-8). The compaction <br />tests exceeded the design specifications. Attachment 1 contains the test results. This <br />as-built report confirms the construction of the Colorado Mined Land Reclamation Division, <br />The embankment is stable, evidencing no indications of slope instability. <br />To the best or my knowledge, based upon my professional expertise, and to the extent <br />possible, this embankment and spillways at the Seneca II-W Mine was constructed in <br />accordance with the prudent state-of-the-art of earthen embankment construction. Further, <br />• the structure was constructed in compliance with the approved design, to the extent <br />possible, as specified in Appendix 7-B and 7-BA of Peabody Coal Company's approved mine <br />
