As stated in the Division's Rationale or ~s provided in testimony <br />during the hearing, the Applicant has adequately and ar;curately identified all surface and <br />groundwater resources on affected and adjacent lands through submission of Exhibits B, <br />C-1, C-2A, C-2B and C-2C. There aze no known perennial streams within the boundaries <br />of the proposed affected lands. A portion of Cottonwood Creek lies within the proposed <br />permit boundaries, but it is greater than 3,000 feet from the proposed affected land and is <br />not expected to be impacted by quarry operations. <br />The weight of the evidence demonstrates that the Applicant has met the minimum <br />requirements o£Rule 6.4.7. <br />Issue 7(E), Management of Water to Protect Against Surface Water PoAution (liule <br />6.4.7(2)(c)). The Applicant has provided a comprehensive sediment at:d erosion control <br />plan for the site which addresses management of stormwater runoff, and minimizes the <br />potential for impacts to surface and groundwater quality and supply. 'Che Applicant will <br />provide "As-guilt Certifications" from a certified registered professional engineer within <br />60 days of completing all hydraulic structures and will verify that alt such structures have <br />been installed properly based on designs provided in the mitring and reclamation permit. <br />The Applicant has also committed to conducting an annual survey and maintenance of all <br />drainage structures. As stated in the Division's Rationale and as noted during the <br />hearing, the Applicant has committed to securing a Colorado Dischazge Permit <br />System/NationaIPotlution Discharge Elimination System permit ("Discharge Permit's <br />from the Colorado Water Quality Control Commission prior to any offsite discharge. <br />The Applicant has also provided an adequate monitoring program to ensure protection of <br />MMRR Boazd Order.
