M-2004-067 <br />THIS MATTER came before the Mined Land Reclamation 13oazd ("Board") on <br />December 14, 2005, in Deaver, Colorado for a hearing to consider the request of Clear <br />Czeek District Water Providers, LLC ("Applicant") for a Section 132 Reclamation Permit. <br />The file number in this matter is M-2004-067. Christopher Hayes appeared on behalf of the <br />Applicant. Hatvey Curtis, Patricia Ivladsen, Hillary Mogue Graham, Corey Iiof&nan and <br />David Kueter appeared on behalf ofpazty objector City of Black Hawk. I~im Serer and <br />Staci Usagani appeazed on behalf ofparty objector Black Hawk/Central City Sanitation <br />District. $rad Hill appeazed on behalf of party objector Estella Leopold. Steve Brown appeazed on <br />behalf of the Division of Minerals and Geology ("Division"). <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby entezs the following Findings of Fact, Conclusions of <br />Law and Order: <br />The Applicant intends to extract aggregate from a quarry to be developed on a 526.70- <br />acre site located in Section 6, Township 3 South, Range 72 West, 6`" Prime Meridian, <br />Gilpin County, Colorado. Within the permit boundaries, the Applicant intends to develop <br />39.28 acres of affected lands, of which 17.6 acres will be in quarry production.
