Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology has completed review of the 4th quarter reports submitted <br />for sediment ponds, refuse piles, and Discharge Monitoring Reports(DMR's) for the New Elk <br />Mine. Please find the results of this review under the respective headings below. <br />Sediment Ponds <br />The reports meet the annual requirement of Rules 4.05.9(14) and (15) and each is certified by a <br />registered professional engineer. The reports also meet the requirements of Rule 4.05.9(17) <br />and Rule 4.05.9(21). Water and sediment storage are noted as conditions allowed. Pond 7 <br />report notes the resetting of the sediment marker but the inspection date must be in error <br />(3/13/2003?). <br />Refuse Piles <br />The two reports meet the requirements of Rules 4.09.1(11) and 4.10.2(2). The inspection of the <br />RDA documents re-shaping of the operational pile surface and future plans to conduct <br />maintenance of the downdrains. The DWP remains to be compaction tested with a loaded haul <br />truck. <br />Discharge Monitorino Reports <br />DMR's document no discharge, which is consistent with observations during Division field <br />inspections. <br />We have no further questions at this time. Please submit future reports to the Division within 30 <br />days following the end of the previous calendar quarter.
