6.4.15 EXHIBIT O -Owner(s) of Record of Affected Land (Surface Area) and <br />Owners of Substance to be Mined <br />Please see comments under Exhibit C. <br />6.4.16 EXHIBIT P -Municipalities Within Two Miles <br />This section is adequate as submitted. <br />6.4.17 EXHIBIT O -Proof of Mailing of Notices to Countv Commissioners and Soil <br />Conservation District <br />This section is adequate as submitted. <br />6.4.18 EXHIBIT R -Proof of Filine with Countv Clerk and Recorder <br />This section is adequate as submitted. <br />6.4.19 EXHIBIT S -Permanent Man-Made Structures <br />The access road thorough the plant site should be listed as a structure along with the stock <br />ponds and any stock fences that could be affected by mining and reclamation activities. <br />The agreements with the utilities and the engineering analysis for the fiber optic line and <br />the railroad line are adequate to address proposed impacts of the mining and reclamation <br />plans. The excerpted purchase agreement for a new access road appears to be adequate <br />as it describes the location of the road and proposes remedies for damage repair. <br />However, the excerpted purchase agreement does not contain the legal description that <br />the agreement is pertaining to. As a result, the agreement does not adequately address the <br />impact to existing water lines or stock tanks, which appear to be located on State Land <br />Board property. Who owns these lines and tanks? Once that is determined, a damage <br />agreement (which cleazly describes the impacted structures and their locations) between <br />the owner and the operator should be executed. In addition, a damage agreement for the <br />stock ponds and stock fences should atso be executed with their appropriate owners. <br />6.5 GEOTECHNICAL STABILITY EXHIBIT <br />(1) On asite-specific basis,...This slope stability issue has been adequately <br />addressed in the permit application. <br />(2) On asite-specific basis, ...The slopes proposed in this permit application <br />do not require geotechnical analysis. <br />(3) Where there is the potential for off-site impacts...The <br />Operator/Applicant has adequately addressed the offsite impacts through <br />sepazation and through agreements with the appropriate parties. <br />12 <br />
