Shelton <br />Director <br />DATE: December 9, 1982 <br />T0: Pittsburg and Midway, Fish Creek Mine File <br />FROM: Jerry Zimpfer <br />RE: Meeting, November 19, 1982 <br />On the afternoon on November 19, 1982, Jim Pendleton, Roy Cox, Dave Criag, <br />Bob Liddle, and myself met with representatives of Pittsburg and Midway <br />Coal and their consultant, Kaman Tempo. The meeting focused primarily <br />upon alluvial valley floors as related to the future Fish Creek under- <br />ground mine, although other hydrologic issues and subsidence were also <br />discussed briefly. A few of the topics discussed at this meeting are out- <br />line below. <br />The company wanted to know on what basis the alluvial valley floor signif- <br />icance determination would be made. The Division responded that Rule <br />2.06.Pi~(b) directs that the determination be based upon the significance <br />of the affected AVF to the farm's production. Therefore, the Division <br />will need information of both the production of the alluvial valley floor <br />and the production of the farm as a whole. We suggested that the company <br />attempt to find a common measure in which to express the productivity of <br />the diverse agricultural activities of the farm. (In subsequent phone <br />conversations with the company's consultant, this position was changed. <br />We agreed that the productivity of each agricultural activity practiced <br />on the farm should be expressed in terms of whatever units are an appropri- <br />ate measure of that activity. For example, measure wheat production in <br />bushels.) <br />The company wanted to know what farm boundaries should be examined since <br />the boundaries have frequently changed. We responded that it would be <br />best to use the farm boundaries as they existed on August 3, 1977. If <br />this is not possible, because information on agricultural productivity <br />at that time is not available, the company may use the current farm <br />boundaries. <br />The company asked if the alluvial valley floors were "grandfathered" as <br />result of CYCC's past mining activities, and how might this affect their <br />
