The Division has notified the DOW that this <br />application has been filed and has requested that if they have any comments or <br />objections they should submit them to the Division within twenty (20) days of the date of <br />the newspaper public notice. <br />3) Ms. Estella Leopold noted that an active nest of Golden Eagles exists on a cliff just in <br />the northwestern most corner of Mr. Wolfs land in section 23. The Rules, Section 6.4.8 <br />(1) (c), require that the Operator/Applicant include a description of the presence and <br />estimated population of threatened or endangered species from either federal or state <br />lists on or in the vicinity of the application area. This description has not been provided <br />by the applicant. The Division suggests that the applicant contact the Colorado DOW <br />and the U.S. Fish and Wildlife Service (USFWS) and request the necessary information. <br />A copy of the appropriate contact for the US FWS is attached. A copry of the adequacy <br />review letter with this suggestion will be forwarded to the DOW and USFWS. <br />
