r~
21710 Highway 550 South
Montrose, Colorado 81401
May 29, 2001
Division of Minerals and Geology
Department of Natural Resources
1313 Sherman Street, Room 215
Denver, Colorado 80203-2273
Dear Sir:
RECEIVED
MAY 3 1 2001
Division of Minera~s and Geology
I need [o bring to your attention a very serious matter concerning United Companies Colona Pit
located in Montrose County. My neighbors and 1 are members of the Ouray Ditch Company, as
is United Companies with their employee Sprague Maygar now in charge of the ditches.
In visiting with my neighbors the Stuart Chappells and Hollis Hasty, I learned that United
Companies has moved irrigation ditches on then property so that we are no longer receiving our
water rights. According to Stu, he contacted United Companies last week and was promised that
Sprague would call him. He hasn't called Stu yet.
Because we are no longer receiving our water, our pastures are drying up and my fruit trees and
lawns are in danger of dying. Stu told me that last year United Companies removed the headgate
without our knowledge or consent. He said last week he tried to trace the flow of water and could
not find our original ditches, that they were dredging new ones and others were blocked with
debris.
Stu also brought to my attention that there is now a "lake" down below that was designated a
wetlands, apparently in exchange for the loss of wetlands in Ouray County -one problem, by
blocking off that water into a lake or pond, I've lost my ONLY source of irrigating my lower
pastures. That water is supposed to flow into a ditch and then into a pipe that crosses South Canal
onto my property.
When Mr. Bruce Humphries conducted the state hearings in 1994, we were led to believe that
United Companies had to obey the laws just like any other company and if we had problems, we
were to notify the state. Now we are.
You can reach me at work at (970) 249-8609 7 AM to 8 PM Tuesday through Friday or call our
home at (970) 249-1301.
Thank you for investigating this matter and helping us resolve this.
Sincerely,
.~
Gruc~ Gr
l~nice E.
