Dear Mr. Lohr:
On July 19, 2001, the Division of Minerals and Geology received a Succession of Operators package for the transfer of the
Dowe Flats Mine from Southdown, Inc. to CEMEX, Inc. The Division cannot process the Succession of Operators
application as submitted for the following reasons:
Current Permitted Operator. The current permitted operator of the Dowe Flats Mine is Southwestern Portland
Cement. The Division can accept the application with the Operator name listed on Page 2, Page 4, and Page 5 {all
of the highlighted areas) as Southdown, Inc dba Soothwestem Portland Cement.
The Division is also returning the Succession of Operators Application form and the Performance Warranty for the
following reasons:
Succession of Ouerator Application: Notarization of Signatures should read:

and the Notary for Successor should read:

Performance Warranty: The Performance Warranty is improperly signed and notarized The Operator (Page 3)
of the Lorimer County Quarry is not Mr. Heintz but CEMEX, Inc. Mr. Heintz should sign on the By: line. The
notarization of his signature should read as the second example above.
