Long <br /> Divivon Diredar <br />lte: Dowe Flats Mine, Permit No. M-1993-041, Succession of Operators Application <br />Dear Mr. Lohr: <br />On July 19, 2001, the Division of Minerals and Geology received a Succession of Operators package for the transfer of the <br />Dowe Flats Mine from Southdown, Inc. to CEMEX, Inc. The Division cannot process the Succession of Operators <br />application as submitted for the following reasons: <br />Current Permitted Operator. The current permitted operator of the Dowe Flats Mine is Southwestern Portland <br />Cement. The Division can accept the application with the Operator name listed on Page 2, Page 4, and Page 5 {all <br />of the highlighted areas) as Southdown, Inc dba Soothwestem Portland Cement. <br />The Division is also returning the Succession of Operators Application form and the Performance Warranty for the <br />following reasons: <br />Succession of Ouerator Application: Notarization of Signatures should read: <br />T71e foregoing instrument was acknowledged before me this 8"' day of March 2001 by Daniel W. <br />Heintz as Vice President of Southdown. Inc dba Southwestem Portland Cement . <br />and the Notary for Successor should read: <br />The foregoing instrument was acknowledged before me this 8a' day of March , 2001 by Daniel W. <br />Heintz as Vice President of CEMEX. Inc. . <br />Performance Warranty: The Performance Warranty is improperly signed and notarized The Operator (Page 3) <br />of the Lorimer County Quarry is not Mr. Heintz but CEMEX, Inc. Mr. Heintz should sign on the By: line.
