Batley <br />RE: Queens Canyon Quarry, Snyder Quarry, Pikeview Quarry, Castle <br />Sand Plant and Castle Sand Pit <br />Our File No.s 77-209, 77-210, 77-211, 77-212 and 77-213 <br />Dear Mr. Batley: <br />~II ~I~II~II~~~~I ~II <br />999 <br />Upon reviewing your recent applications for Mining and Reclamation <br />Pernrits, dated September 14, 1977, the staff has detet~nined that they <br />are deficient under the Colorado Mined Land Reclamation Act, Article 32 <br />of Title 34, C.R.S. 1973, as amended (1976 Sess. Laws - H.B. 1065). <br />The following items must be corrected or resubmitted in order for the <br />applications to be considered as filed: <br />1. Pursuant to Rule 1.33 (Rules and Regulations- (',~~,-.,~aclo Plined Land <br />Reclamation Boat'd, play, 1977) an operator may mark "Confidential" <br />information supplied in a permit application disclosing the location, <br />size or nature of the deposit or depth and thickness of the ore <br />body or del%o sit and thickness and type of overburden to be removed. <br />On September 2, 1977, the Mined Land Reclamation Board made a <br />ruling which states: "Confidential material must be submitted in a <br />form such that it can be segregated from the application without <br />also segregating non-confidential items." <br />In each of your following applications: Queens Canyon Quarry (77-209); <br />Snyder Quarry {77-210); Pikeview Quarry (77-211); Castle Sand Plant <br />(77-212); Castle Sand Pit (77-213), the mining plan (Exhibit D), <br />mining plan maps (Exhibits C-1 & C-2), the reclamation plan (Exhibit E) <br />and the reclamation plan maps (E;cliibit F) were marked as confidential <br />thereby denying public access to non-confidential information <br />contained in them. <br />This situation can be rectified by your resubmission of the above <br />material or by your obliterating the confidential material contained <br />in each of the items in the copy we make available to the public. <br />Additionally, the copy left for public inspection in E1 Paso County <br />
