UPPER CLEAR CREEK
WATERSHED ASSOCIATION
P. O. BOS 3058
IDAHO SPRIX[3.5, CO 80~45~
January 18, 2005

Mr. Bruce Humphries
Division of Minerals and Geology JAN 1- g ~
1313 Sherman Street, Room 215
Denver, CO 80203 Diuiaion of Minarais and Gaulog~
RE: Pending Application M2004067
MMMR Quarry
Gilpin County
Deaz Mr. Humphries:
The Upper Cleaz Creek Watershed Association (UCCWA) was recently notified that the
Division is considering an application from Cleaz Creek District Water Providers for a
gravel quarry in Gilpin County. The Upper Cleaz Creek Watershed Association is the
designated 208-management agency responsible for overseeing water-quality and water-
resourcesissues through the upper Cleaz Creek watershed. Our membership includes
twenty municipalifies, counties, and dischazgers located in the upper Cleaz Creek
watershed in Cleaz Creek and Gilpin Counties.
UCCWA is concerned that the current application does not adequately identify potential
metal, nutrient and sediment impacts from the operafion to the North Fork of Clear Creek
or offer a plan to mitigate these impacts. In addition, UCCWA would like to express its
support of Gilpin County's authority over land use issues at the site including the
requirement for a special use permit.
Thank you for the opportunity to provide comments.
Sincerely, ~
~~
Anne Beierle
Chair
Upper Cleaz Creek Watershed Association
Cc: Roger Baker, Gilpin County
Rick Fendel, Petrock & Fendel
Mike Crouse, Douglas Mountain Residents' Association
