There are <br />three areas of consumptive use that arise from an operation of <br />this type. These include moisture loss Prom gravel hauled from <br />the property, dust control of haul roads and water used in the <br />concrete batch plant. <br />Water losses due to lake evaporation during mining is not <br />considered as a consumptive use. This is based o» the current <br />ruling by Judge Behrman in Division I Water Court on the Zigan <br />Case. It was specifically stated in Chia case that water <br />augmentation for lake evaporation is not required during mining <br />operations. The case is currently being appealed in the Colorado <br />State Supreme Court by Mr. Zigan and the State Engineer. The mining plan has bean <br />designed such that no impact will be felt by adJoining property <br />owners. Oravel mining operations in general are beneficial to a <br />' river floodway.
