<br />The public road (State Highway 61) is a valid concern if we were mining north to south. <br />However, since the mining as shown on our mining plan is south to north there will be <br />no disturbance of the land between Highway 61 and the existing and future pit area for <br />at least 200 feet. This original pit was dug to build State Highway 61 and for at least <br />fifty years this has not affected this Public Road in anyway. The State Highway <br />Department was sent a referral concerning the April 13, 1999 Special Use Public <br />Hearing and did not respond which indicates that they had no concerns. <br />The Army Corps' of Engineers letter specifically states that a dredge and fill permit is <br />not required and no other suggestions were made. Prior to receiving the Division of <br />Wildlife Letter our discussions with the rancher who grazes cattle near our lease <br />indicated that the cottonwood trees on the site for hawks. At our Special Use Public <br />Hearing this concern was raised by staff and one of our County Commissioners. <br />Our Planning Commission and Board of County Commissioners approved the Special <br />Use Permit subject to taking all possible measures not to damage the trees. <br />Specifically, Mr, Terrill, our Landfill Supervisor who is supervising the project, will give <br />orders to all County Employees working in the pit to leave the trees intact and not mine <br />within at least twenty foot circumferences of the trees. I have communicated this to <br />Bob Terrill verbally and in writing.
