Thank you for your phone call and fax. I also appreciate your call to Lesley <br />Baxster concerning the deadline and the extension. Unfortunately, I was not able to <br />respond as quickly as I wanted to because in this County I'm also the Personnel <br />Director and have County Administrator assignments. I prepared and signed a letter <br />that I was going to deliver to you on Thursday May 22. However, when t spoke with <br />Lesley Thursday morning and realized the fence issue was solved I revised this letter <br />today. <br />1. Proof of Publication is enclosed. <br />2. The only adjacent land owner within 200 feet of the affected area is the Colorado <br />State Land Board from which Logan County has a lease to operate the proposed Clay <br />Pit on 9.96 acres of their property. This information is included within the submittal. As <br />a courtesy, we contacted the rancher who has a grazing lease, in person, on the <br />telephone and by certified mail (receipt enclosed). We also contacted all property <br />owners within a one mile radius of the site. <br />3. Logan County does not need a Storm water permit from the Colorado Department of <br />Health Public Health Environment, Water Quality Control Division because this <br />property is at least three and one half miles from any river, stream or drainage way and <br />all storm water will be retained on the site because of the topography of the site and the <br />design of the clay pit. Specifically, the topography of the site slopes north to south. <br />There will be no mining within the haul road area which is feet from the fence and feet <br />from the boundary or the site. This site had a previous mining operation which is at <br />least fifteen feet deep and is located within the southern portion of the site. The face of <br />the old pit is approximately fifteen to twenty feet from the northern fence line. While the <br />primary purpose of this pit is to mine clay for our landfill liner there is more gravel and <br />sand on the site than clay. Therefore, with all storm water being retained on the site <br />and with a gravel deposit underneath acting as one of natures best water filtering <br />
