BOX A Drvislon Drreonr <br />Akron, CO 80720 <br />RE: Adequacy of the Permit Application, Washington County, Nickell <br />Pit; File No. M-94-077 <br />Dear Mr. Paynter: <br />The following items must be addressed for the above referenced <br />application to be adequate under the Mined Land Reclamation Act: <br />1. On the updated application form submitted to the Division on July <br />28, 1994, you have indicated that the pre- and post-mining land <br />use for this site is pastureland. Review of the site description <br />prepared by the SCS, and review of the proposed reclamation plan, <br />indicates that the site would more accurately be characterized as <br />rangeland. Please acknowledge that the pre- and post-mining land <br />uses are rangeland. <br />2. On the updated application form submitted to the Division on July <br />28, 1994, you have indicated that the permit area will be 8.51 <br />acres. The access road must be included in the permit area making <br />the total permit area 9.42 acres. Please acknowledge that the <br />road is included in the permit area, and also provide reclamation <br />details for the road. Alternatively, you may leave the road as a <br />post-reclamation feature if you can provide written acceptance <br />from the surface owner. <br />3. Please commit to stabilizing the topsoil stockpile by establishing <br />grasses on the stockpile during the first growing season following <br />soil salvage. <br />4. The way that the mine plan currently reads, Washington County <br />would have the latitude to lower the Vega Creek stream bed up to <br />ten feet within the permit area. Lowering of the stream bed to <br />this extent would result in head-cutting at times when the stream <br />is flowing, causing bank degradation and erosion outside the <br />permit area to the south. The applicant must either commit to <br />limiting the maximum vertical extent of stream bed excavation, or <br />must submit a plan to prevent head-cutting. <br />
