Costilla ___ -County __~ ("operator") desires to con- <br />duct a mining operation known as Costilla __ _Count,Y______ <br />for the purpose of extracting ~3}d and eravel __ <br />3. Cn Fa}~r„~r~ 7rh . 1981, the M i ned land Rec 1 amat i on <br />9oard ("the board") approved operator's application for <br />this permit, fixed the amount of Dond and directed that <br />this permit be issued upon the filing with the Mined Land <br />Reclamation Division ("the division") Of bond in the amount <br />so fixed together with surety or sureties thereon in form <br />and substance approved by the division, and such bond and <br />sureties have been so furnished. <br />C. The board on February 25 , 1981 made the following find- <br />ings: <br />1. the application for tnis permit complies with the <br />requirements of the Colorado Mined Land Reclamation <br />Act, C.R.S. 1973, 34-32-101 g,~,sed. as amended ("the <br />Act") and with all applicable local, state and federal <br />laws; <br />2. the operation will not adversely affect the stability <br />of any significant, valuables and permanent man-made <br />structure located within two hundred feet of the affected <br />land. except where there is an agreement between oper- <br />ator and the pef50n5 hdvi ng do interest in the strVC- <br />ture that damage to t,ne structure is to be compensated <br />for by operator; and <br />3. the proposed mining and reclamation operations can be <br />carried out in conformance with the requirements of <br />the Act. <br />D. Dperacor has matle a showing Satisfactory to the board: <br />(1) that ;t will employ, during and after its underground <br />mining and surface operations, procedures reasonably designed <br />to minimi2er as much as practicable, environmental tlisturb- <br />dnCe from Such Operations; (2) thdt it will provide fcr <br />reclamation of the affected lands appropriate to the suose- <br />quent benef;cial use of such lands; and (3) that, in the <br />event of the failure of its proposed reclamation plan. it <br />will take whatever measures may be necessary to assure the <br />success of reclamation of the lands affected by such oper- <br />
