Dear Mr. Oehler:
On June 14, 2004, we submitted an MLRB 112 Application for the Tucson South Resource
gravel mine site in Adams County, CO. Pursuant to Construction Materials Rule (Rule) 1.6.2(d)
and 1.6.5, the Public Notice was published in the Brighton Standard Blade for four consecutive
weeks from June 30`" to July 21, 2004. Enclosed is the affidavit of publication issued by the
newspaper. As required by Rule 1.6.2(e) the public notice was sent by certified mail to surface
and mineral owners of record, and land owners within 200 feet of the site boundary. Enclosed are
copies of the certified mail receipts for your record.
The mineral owners/leases identified in Exhibit O of the application was updated based on a
records search by Contex Energy. The updated search was completed prior to the issuance of the
public notice. In addition, the property owner for parcel 1571-12-1-00-007 was identified on the
`Cover Sheet/Overall Plan' as Barton Stough, however the current owner is Kevin Bernard. The
public notice was sent to the current property owner.
As required by the DMG regulations, a copy of this information was submitted to the Adams
County Clerk and Recorder. On the same date the DMG receives this application, a copy of the
"Receipt of Application" signed by the Clerk will be forwarded by fax.
