Total Recoverable Metals - By federal register of September 26, 1984, EPA <br />now allows the use of total recoverable metals effluent limitations in <br />permits. Such limitations are no more restrictive than total metals <br />limitations and may be less restrictive. This change will not alter the <br />sampling and sample preservation technique, but does warrant a change in <br />the analytical procedure. It is therefore important that the permittee <br />alert its laboratory to this change. <br />D. Storm Exemption - Federal effluent guidelines contain provisions for <br />meeting certain alternate limitations, instead of technology-based <br />limitations, for precipitation-caused discharges. This "storm exemption" <br />applies to surface runoff discharges or mine drainage commingled with <br />surface runoff. The exemption does not apply to water quality standard <br />based limitations, nor to discharges emanating from areas not active or in <br />the post-mining phase as described in the federal regulations. <br />E. Materials Containment Plan - Pages 6 and 7 of the permit describe the <br />Materials Containment Plan (MCP) which is a requirement of all <br />permittees. If a Spill Prevention Control and countermeasure (SPCC) Plan <br />hae already been submitted by the permittee and approved by, the Division, <br />submittal of an annual update to this plan will satisfy the MCP <br />requirement. <br />F. Reopener Clause - This permit may be reopened and modified as discussed in <br />Part II.B.S. If there is a significant change in state or federal water <br />quality regulations, a significant change in operation at the facility, or <br />at the request of the permittee. <br />G. Compliance Dates <br />The following items must be submitted by the specified date under the <br />conditions of this permit. <br />a. Materials Containment Plan, Part I.E.1. <br />- 90 days from effective date (applies to annual update if MCP is on <br />file). <br />b.
