General Wildlife Protection Procedures. As further protection of the wildlife resource during and after <br />• mining, the following considerations or actions have been, or will be taken: <br />1. No critical habitat for any threatened or endangered species is located on or near the project <br />area (see monitoring discussionl. <br />2. There are no wildlife migration routes on the permit area which would require special <br />fencing. <br />3. The revegetation seed mixtures and planting regimes for the drainage courses were <br />designed specifically to maximize the growth potential of the moist areas. <br />4. There have been no toxic water problems identified at the Seneca II-W Mine. NPDES Permit <br />CO-00021 requires monitoring on an ongoing basis. <br />5. Pesticides will only be used in accordance with County restrictions and the Colorado <br />Pesticide Act. Herbicides will be used only to control noxious weeds and only when <br />necessary. If persistent herbicides are to be used, approval will first be obtained from <br />Colorado Division of Minerals and Geology IDMGI and the local weed and pest control <br />district. All labels, restrictions, and instructions will be strictly adhered to. <br />6. Fire control will be exercised for range, forest, and coal fires which are not approved by the <br />regulatory authority as part of a management plan. <br />7. The Planting Plan (Exhibit 22-11 optimizes the diversity of plantings within and around the <br />range land to enhance wildlife habitat. Wetland plantings along drainages will reestablish <br />wetland areas. <br />• 8. All mine associated powerlines will be constructed according to REA Bulletin 61-10, <br />Suggested Practices for Raptor Protection on Powerlines: The State of the Art in 1981 <br />(Olendorff, et al.l; or the best technology currently available at the time of construction. <br />9. Fences will be constructed with oleo-inch distance between the top two strands of barbed <br />wire to reduce the possibility of big game getting hung up in the fence when crossing. This <br />fencing design should not inhibit big game movement. <br />10. Access to the mine area will be restricted and consequently, the disturbance of wildlife <br />species and nesting raptor species will be eliminated or significantly reduced. Disturbance, <br />if it occurs, to any golden eagle nest will be reported to local CDOW and USFWS personnel <br />immediately upon notice of such an incident. <br />Tie-Across Haul Road <br />The history of the permitting of the final location of the tie-across haul road ITAHRI is long and <br />involved. The final road right-of-way was selected primarily to avoid disturbing an area important io <br />sandhill cranes for dancing and breeding activities. There are no other known habitats for species of <br />high State or Federal interest along the TAHR corridor Isee the attached letter from J.M. Haskins, <br />CDOWI. The TAHR was constructed in 1989. If excessive deer or elk mortality from big game vehicle <br />accidents occur on this road, DMG and CDOW will be contacted to develop an appropriate course of <br />action. <br />3 Revised 9/98 <br />
