We have no record that you have applied for or obtained a storntwater <br />permit for the above-referenced site. <br />In 1987, the US Congress amended the Clean Water Act to expressly include s[ormwater discharges <br />from industrial sites as requiring Clean Water Act controls. In 1990, EPA issued regulations that <br />require specific industrial activities to obtain permits in order to discharge s[ormwater from their <br />facilities. Facilities involved in aggregate mining and processing are specifically included. <br />The Water Quality Control Division of the Colorado Health Department has direction and authorigr <br />to administer this program in Colorado. The Division has issued general permits for the regulated <br />industrial activities. An application form for the General Permit for Stormwater Discharges from <br />Sand and Gravel Mining has been enclosed for your use. Please complete the application and submit <br />it to our office by December 19, 1997. Note that the application must include certification of <br />completion of a Stormwater Management Plan (SWMP), and that the SWMP must be fully <br />implemented by the time the permit is issued. I have included a fact sheet describing the Stormwater <br />program. <br />If you fail to obtain a required stomtwater permit and discharge stormwater from this site, you are in <br />violation of the Clean Water Act and are subject to enforcement action by the Water Quality Control <br />Division. The Clean Water Act authorizes both civil and critttinal penalties for willful non- <br />compliance. <br />The same holds true for any discharges of process or mine water from your site. If you have or <br />intend to have any such discharges, you will need a different application (also available from our <br />office). <br />
