Division Comment <br />The Division's position is that the Geotechnical Stability report and the engineering plans for the <br />access road indicate sufficiently that the road will be stable. The Division is willing to approve <br />these plans for installation of the roadway, with the following conditions, to which the applicant has <br />agreed: <br />• The fill section of the access road will be constructed as a mechanically reinforced embankment <br />as shown in the preliminary access road designs dated August 31, 2005. <br />• The cut section of the access road will be constructed and reinforced in accordance with the <br />retaining structure and subsurface drain system recommendations contained in the Trautner <br />Report dated October 21, 2005. <br />• The access road will be constructed in accordance with the construction recommendations <br />contained in Section 8 of the Trautner Report dated October 21, 2005. <br />• The DMG shall be provided a general schedule for construction of the road to facilitate <br />scheduling of site inspections. The general schedule must be provided at least 30-days prior to <br />initiation of road construction. <br />• No more than 60-days following completion of road construction, the DMG will be provided <br />with an as-built construction report and as-built drawings detailing all aspects of how the road <br />was constructed. <br />If the Operator wants to make significant changes to the plans for road construction as they have been <br />described in the application, afrer the permit is issued, such changes must be reviewed and approved by <br />DMG as technical revisions or amendments to the permit. <br />B. ISSUES RAISED DURING THE INITIAL COMMENT PERIOD THAT THE DIVISION <br />BELIEVES ARE NOT WITHIN THE JURISDICTION OF THE DIVISION OR BOARD <br />1. Traffic <br />The Gundersens letter referred to an e-mail from the Colorado Department ofTransportation to <br />the La Plata County Planning Department which states that the proposed operation will have <br />significant impacts to the state highway system. <br />Division Response <br />State Highway traffic issues fall under the jurisdiction of the Colorado Department ofTransportation <br />and not the Division of Minerals and Geology <br />2. Right of Wav <br />The Gundersens letter states that The La Plata County Planning Department is requiring an <br />additional right ofway, which must be approved by the Gundersens prior to county approval of <br />the operation. Further, the Gundersens are not willing to approve the right of way. <br />
