Sherman
Executive DIlBCtOr
Ronald W. Cattany
Division Director
Natural Resource Trustee
The Division received your adequacy response for the Bennett Pit 110 Application, File No. M-2007-021.
The Division has one fmal item that needs to be addressed prior to approval of the application:
The applicant states hat the gas well and meter house lie outside the area to be directly affect by mining.
Houston Exploration (owner of the gas well and meter houses) has indicated they will provide a letter of
no negative effect. Please provide a copy of the letter from Houston Exploration or commit to staying a
distance of 200 feet from the well structures until the agreement is submitted to the Division. As an
alternative the applicant can provide an appropriate engineering evaluation that demonstrates that such
structures will not be damaged by activities occurring at the mining operation.
Please be advised that the Bennett Pit application may be deemed inadequate, and the application may be
denied on May 13, 2007 unless the above mentioned adequacy review items are addressed to the
satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can gant
an extension to the decision date. This will be done upon receipt of a written waiver of your right to a
decision by May 13, 2007 and request for additional time.
