Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received your adequacy response for the Bennett Pit 110 Application, File No. M-2007-021. <br />The Division has one fmal item that needs to be addressed prior to approval of the application: <br />The applicant states hat the gas well and meter house lie outside the area to be directly affect by mining. <br />Houston Exploration (owner of the gas well and meter houses) has indicated they will provide a letter of <br />no negative effect. Please provide a copy of the letter from Houston Exploration or commit to staying a <br />distance of 200 feet from the well structures until the agreement is submitted to the Division. As an <br />alternative the applicant can provide an appropriate engineering evaluation that demonstrates that such <br />structures will not be damaged by activities occurring at the mining operation. <br />Please be advised that the Bennett Pit application may be deemed inadequate, and the application may be <br />denied on May 13, 2007 unless the above mentioned adequacy review items are addressed to the <br />satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can gant <br />an extension to the decision date. This will be done upon receipt of a written waiver of your right to a <br />decision by May 13, 2007 and request for additional time.
