I appreciate your bringing the matter
to my attention and apologize for any inconvenience that may have resulted.
I have personally looked into the matter and can assure you that discharge point 001
has now been deactivated within our computer data base. As you note in your letter
outfall 001 was deleted by the permit action dated May 30, 1996. Unfortunately, our
computer data base was not updated, an item which I am looking into further. Given the
proper deletion the discharge point, the letters of October 17, 1996 and January 17,
1997 were in error as not violations had in fact occurred.
I again apologize for any inconvenience and appreciate your understanding on this
matter.
Sincerely,
~~f~ ~~
Robert , Shukle, Chief
Permits & Enforcement Section
WATER QUALITY CONTROL DIVISION
cc: Bryan Archer, Sun Coal Company
Susan Burgmaier, CDMG
Jim Chubrilo, FS
MS-3
Loryal Health Dept.
