_ ~ ~~ <br />. . <br />OPERATION STANDARDS <br />LA POUDRE SAND b GRAVEL INC. <br />USR-571:83:34 <br />1. The uses permitted on said described parcel shall be the extraction <br />of sand and gravel, as described in the application presented by <br />La Poudre Sand 6 Gravel Inc. and as amended in a letter dated August 11, <br />1983 from their consulting engineers. The amended application will be <br />on file in the office of the Department of Planning Services. <br />2. The open-cut gravel operation shall comply with Section 44.4, <br />Operation Policies. Any violation of these regulations shall be <br />grounds for enforcement of Section 44.5, Cancellation of Permit. <br />3. All phases of the sand and gravel operation shall comply with all <br />County and State Health Standards and regulations pertaining to air <br />quality, water quality, noise emission and sanitary disposal systems. <br />4. The property owner(s) and/or operator shall apply for a well permit <br />with the Division of Water Resources to comply with CRS 37-90-137. <br />5. The applicant shall obtain a N,P.D.E.S. Permit from the Water <br />Quality Control Division of the Colorado State Health Department <br />prior to discharge of any water in the La Poudre River. <br />6. All operations on said described parcel shall be in conformance <br />with the Weld County Flood Hazard Regulations indluding: <br />A. NO fill, berms or stockpiles shall be placed in the one- <br />hundred (100) year flood plain of the La Poudre River which <br />would obstruct passage of flood flows; and <br />B. All fuel tanks, septic tanks, temporary buildings, and any <br />other hazardous items that might wash away during flooding <br />shall be securely anchored and adequately flood-proofed to <br />avoid creation of a health hazard. Following completion of <br />mining, all temporary buildings shall be removed. <br />7. Vehicular traffic shall ingress ana egress onto Weld County Road 13 from <br />not more than two (2) access points. The main access point shall be <br />located south of the Cache La Poudre River, utilizing a farm road <br />which services the southern boundary of the extraction area. The <br />alternate access point shall be the existing access north of the Cache <br />La Poudre River for SUP-409:79:31. The points of ingress and egress <br />shall be maintained for dust abatement for a distance of thrty (30) <br />feet from Weld County Road 13 to the extraction area. Dust abatement <br />shall be controlled by either oiling or paving, depending on the <br />maintenance agreement for Weld County Road 13. <br />8. Copies of all documents filed with the Mined Land Reclamation Board <br />that are pertinent to this case shall be forwarded by the applicant <br />to the Department of Planning Services office for review. <br />9. The Use by Special Review Permit area shall be limited to the plans <br />shown hereon and governed by the Operation Standards stated above <br />and all applicable Weld County Regulations. Any material devia- <br />tions from the plans and/or Operation Standards, as shown or stated <br />above, shall require the approval of an amendment to the Use by <br />Special Review Permit by the Weld County Planning Commission and <br />the Board of County Commissioners before such changes from the <br />plans and/or Operation Standards shall be permitted. Any other <br />changes from the plans and/or Operation Standards shall be filed in <br />the office of the Department of Planning Services. <br />10. Prior to the Board of County Commissioners Public Hearing, a revised <br />set of maps (i.e, premining, mining and reclamation) shall be submitted <br />to the office of the Department of Planning Services to amend the sand <br />and gravel extraction boundaries. <br />MSM:dg <br />
